These Terms of Use (“Terms”) govern your use of the WeightMate Nutrition mobile application (“the app”) published by Bradley Emerson under the developer name Emerson Software Company (“we,” “us,” or “our”) on iOS and Android. By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the app.
Apple App Store license (EULA)
If you obtained WeightMate Nutrition from the Apple App Store, Apple’s Standard Licensed Application End User License Agreement also applies and is incorporated into these Terms:
If there is a conflict between these Terms and Apple’s Standard EULA for an App Store purchase, Apple’s Standard EULA controls for that purchase.
Google Play
If you obtained WeightMate Nutrition from Google Play, Google Play’s terms of service also apply to that distribution relationship.
License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use WeightMate Nutrition on devices you own or control, for your own food and nutrition logging. You may not copy, modify, distribute, reverse engineer, or resell the app except as allowed by applicable law or the store’s terms.
Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the app. If you are under 18, you should use the app only with a parent or guardian’s permission.
What this app is — and is not
WeightMate Nutrition is a food logging and personal feedback tool. It helps you record what you eat, review calories and macros, and — if you choose — see how blood glucose readings from your phone’s health platform may relate to meals you logged.
The app is not:
- Medical advice, medical care, or a medical device
- Nutrition therapy, diabetes management, or insulin dosing guidance
- A substitute for a doctor, registered dietitian, or other licensed professional
- A real-time alert system for low or high blood glucose
- A diagnostic tool for any disease or condition
We do not ask you to tell us whether you have diabetes or any other medical condition, and we do not recommend insulin doses, bolus amounts, medication timing, or other treatment decisions.
Not medical advice — read carefully
All numbers, scores, charts, meal–glucose summaries, pattern labels, and text in the app are informational only. They are based on data you log, third-party food databases, and — if you opt in — blood glucose readings imported from Apple Health or Android Health Connect.
That information can be wrong, incomplete, delayed, or misleading. CGM data shared through Health platforms may arrive hours after the reading. Food database entries may be inaccurate. AI meal photo estimates are guesses, not measurements.
Do not use the app to diagnose, treat, cure, or prevent any disease; to decide whether to eat or fast; to adjust insulin or other medication; or to respond to a medical emergency. Always confirm glucose readings on your CGM or meter and follow guidance from qualified professionals.
Food database entries (including USDA, Open Food Facts, member-contributed barcode foods, and AI meal photo estimates) may be inaccurate, incomplete, or outdated. We do not guarantee allergen information, ingredient lists, or suitability for any medical condition.
Eating and weight goals: The app is not intended to promote extreme restriction or unhealthy relationships with food. If you have or suspect an eating disorder, consult a qualified professional. Do not use the app to pursue dangerously low calorie intake.
If you are pregnant, nursing, have an eating disorder, take medication (including insulin), or have any health concern, consult a qualified professional before changing how you eat based on app information.
Your goals and data are yours
Calorie and macro targets you set in the app are your choices. We do not validate them for your health needs. Discuss goals with a qualified professional before relying on them.
Optional blood glucose and insulin features
If you enable glucose import, the app reads blood glucose data you already store in Apple Health or Health Connect and analyzes it on your device alongside meals you logged. The app describes patterns such as rise from baseline, time to peak, or repeated responses to similar meals. These descriptions are educational feedback about your logged data, not clinical instructions.
If you log insulin doses, those entries are stored on your device only and are for your personal records — not medical dosing guidance.
You can turn glucose import off at any time in Profile. Raw glucose cached on your device and computed outcomes can be removed by disabling the feature and clearing app data, or uninstalling the app.
AI and meal photo analysis
Optional meal photo features use automated systems (including third-party AI) to suggest foods and portions. Output may be wrong (“hallucinated”) and is not a measurement. You must review and confirm anything before you log it. We do not use your photos to train our own models; images are processed to return suggestions for your session.
Meal photo allowances and billing
Meal photo analysis may be subject to usage limits and optional in-app purchases. The rules below apply when metering is enabled for your account:
- Included allowance: Each account receives 10 meal photo analyses per calendar month at no additional charge (whether or not you have a subscription). The included allowance resets on the 1st of each month (UTC). Unused included analyses do not roll over to the next month.
- When a credit is used: We count one meal photo analysis toward your allowance only when the automated analysis completes successfully and returns a result. Network errors, timeouts, server errors, and other failures do not consume an included credit or pack credit.
- Optional photo packs: When available, you may purchase a consumable pack of additional analyses (for example, 50 analyses for a one-time store price). Pack credits are separate from your monthly included allowance. Unused pack credits expire 180 days after purchase and do not roll over after expiry. Pack purchases are handled by the Apple App Store or Google Play; we do not store your payment card.
- Order of use: Included monthly allowance is used before pack credits. When both are exhausted, meal photo analysis is unavailable until your included allowance resets or you purchase another pack (if offered).
- Estimates and refunds: Because AI suggestions can be inaccurate, you are responsible for verifying foods and portions before logging. An inaccurate or unsatisfactory estimate is not grounds for a refund or restoration of a used credit, except where required by applicable store law or store policy.
- Changes: We may change included limits, pack sizes, prices, or availability with notice as described in the Changes section below.
Subscriptions and in-app purchases
Some features may require a paid subscription or one-time purchase. If you subscribe through the Apple App Store or Google Play, billing, renewal, cancellation, and refunds are handled by that store under its terms. Subscriptions auto-renew unless you cancel before the end of the current period in your store account settings.
Meal photo packs (when offered) are consumable in-app purchases, not subscriptions. Each purchase adds a fixed number of analyses that expire as described in Meal photo allowances and billing above. Consumable purchases are generally not restorable after deletion of the app; follow store guidance for billing disputes.
Deleting the app or your account does not cancel a subscription. You must cancel in the App Store or Google Play (or other payment provider) to stop future charges.
Accounts
WeightMate Nutrition may use the same sign-in account as the separate WeightMate fitness app when both use our shared authentication provider. Nutrition data (food logs, targets, recipes) is stored under your account as described in our Privacy policy.
You are responsible for your account credentials and for activity under your account. To request account deletion, see Delete account & data.
Acceptable use
Do not misuse the app, attempt to disrupt it, scrape food databases in violation of their terms, reverse-engineer the app, use automated tools to access our services without permission, or use the app in a way that violates law or these Terms.
Your content
You retain ownership of food logs, recipes, and other content you create. You grant us a limited license to host, process, and display that content solely to operate the app (including syncing across your devices and processing recipe share codes you choose to generate).
Third-party food and health data
The app may query public food databases (for example USDA FoodData Central and Open Food Facts) and optional platform health APIs. Your use of those features is also subject to those providers’ terms and your device permissions.
Privacy
How we collect and use information is described in our Privacy policy.
Disclaimer and limitation of liability
The app is provided “as is.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not liable for indirect, incidental, or consequential damages, or for health outcomes related to your use of the app, including decisions you make based on glucose charts, scores, food database entries, AI estimates, or summaries. Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the maximum extent permitted.
To the extent permitted by law, our total liability for any claim arising from the app will not exceed the greater of (a) amounts you paid us for the app in the twelve months before the claim, or (b) fifty U.S. dollars (US$50).
Indemnification
To the extent permitted by law, you agree to defend and indemnify Emerson Software Company and its operator from claims arising out of your misuse of the app, your violation of these Terms, or content you submit (including shared recipes), except where caused by our gross negligence or willful misconduct.
Termination
You may stop using the app at any time. We may suspend or terminate your access if you violate these Terms or if required for legal or security reasons. Sections that by nature should survive (including disclaimers, limitation of liability, and indemnification) will survive termination.
Governing law
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence apply. You consent to the exclusive jurisdiction of state and federal courts located in Delaware for disputes that are not subject to store-mandated arbitration or small-claims procedures.
Changes
We may update these Terms from time to time. We will post the revised Terms on this page and update the effective date. Continued use of the app after changes means you accept the updated Terms. Material changes may also be shown in the app before you continue using it.
